These Terms & Conditions (“Terms”) govern your access to and use of the My Climate Stories website at www.myclimatestories.com and the personalised climate storybook platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is intended for use by parents and legal guardians on behalf of children aged 5 to 12. You must be at least 18 years old to create an account. By creating a child profile, you confirm that you are the parent or legal guardian of that child and that you have the authority to provide the information and consents described in our Privacy Policy.

You sign in using Google authentication. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Please notify us promptly of any unauthorised use. You agree to provide accurate information and to keep it up to date.

You may upload photos, drawings, observations, and other materials (“Your Content”). You retain ownership of Your Content. By uploading it, you grant us a limited licence to store, process, and use it solely to operate and provide the Service to you, including generating personalised avatars, stories, and illustrations.

You represent and warrant that:

• You have the right to upload Your Content, including photos of children and family members.
• Your Content does not infringe anyone's rights and is not unlawful, harmful, or offensive.
• You have obtained consent from any individual depicted in photos you upload.

The Service uses computer-assisted generation to create stories, illustrations, and avatars personalised for your family. Generated content is provided for your personal, non-commercial, family use. While we strive for quality, safety, and accuracy, generated content is produced automatically and may contain errors or imperfections. We do not guarantee that any generated content will be free of mistakes.

Creating a story consumes tokens. You may earn tokens through activity on the platform or purchase token packages. Payments are processed by our payment provider, Razorpay. Prices and token package details are shown at the time of purchase.

Tokens have no cash value, are non-transferable, and are non-refundable except where required by law. We may modify token pricing or packages from time to time.

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose.
• Upload content that is illegal, violent, sexual, hateful, or otherwise inappropriate, particularly given that the Service is designed for children.
• Attempt to reverse engineer, disrupt, overload, or gain unauthorised access to the Service or its systems.
• Resell, redistribute, or commercially exploit generated content or the Service without our written permission.

We may suspend or terminate accounts that violate these Terms.

The Service, including its design, software, branding, and original content, is owned by My Climate Stories and protected by applicable laws. Except for Your Content and the generated content provided to you for personal use, nothing in these Terms grants you any right to our intellectual property.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, My Climate Stories and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
